US rejects Uber according to drivers

San Francisco - A US judge rejected an attempt by Uber to terminate a collective process in which drivers claim they are employees of the urban transport company for applications and therefore are entitled to reimbursement of expenses.

In a case that is being closely watched by the Silicon Valley, where many companies use employees demand, US District Judge Edward Chen in San Francisco decided that an agreement the company is not fair or appropriate to Uber drivers.

Drivers say they are employees of the Uber and so the company should reimburse the cost of maintenance and fuel for vehicles. These costs are currently paid by drivers.

The agreement proposed by the company would keep drivers with outsourced suppliers. Several drivers are party to the proceedings filed objections to the court, mainly because the amount proposed in the agreement was well below the potential losses in the event, which reach 850 million dollars.

In a statement, Uber said he believes that the offered agreement, valued at up to $ 100 million, was fair and reasonable.

"We are disappointed with this decision and evaluating our options," said the company, which also has operations in Brazil.

The Chen judge cited that an amount of $ 16 million in the proposed agreement would be paid to drivers only if the market value of the company to grow at a certain level within a year after a possible initial public offering (IPO, the acronym in English).

As the Uber can not give specific information on the feasibility of an IPO, Chen said he could not consider the proposed amount as part of an agreement. The 84 million remaining dollars, said the judge, represent a substantial discount on the compensatory amount requested by drivers.
